Please read this End User License Agreement ("Agreement") carefully before using the Respira App ("App"). By using the App, you ("User" or "You") agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, do not use the App.
1. License Grant
Respira grants you a personal, non-exclusive, non-transferable, limited license to use the App for your personal, non-commercial use according to this Agreement.
2. Restrictions on Use
- You may not:
- Copy, modify, distribute, sell, or lease any part of the App.
- Reverse engineer, decompile, or disassemble the App.
- Attempt to derive the source code or underlying ideas of the App.
- Use the App for any illegal or unauthorized purpose.
3. Ownership
All rights, title, and interest in and to the App, including all intellectual property rights, are owned by Respira. This Agreement does not transfer any ownership rights to you.
4. User Responsibilities
- You are responsible for:
- Ensuring that your use of the App complies with all applicable laws and regulations.
- Protecting your device and the security of your personal information.
- Any content you upload, share, or transmit through the App.
5. Health Disclaimer
- The App provides breathwork guidance intended for general wellness. It is not intended to diagnose, treat, cure, or prevent any medical condition.
- Always consult with a healthcare professional before starting any new exercise or wellness routine, especially if you have any pre-existing health conditions.
6. Privacy
Your use of the App is also governed by our Privacy Policy, which describes our practices concerning the collection, use, and disclosure of your personal information.
7. Termination
- This license is effective until terminated. Your rights under this license will terminate automatically without notice from Respira if you fail to comply with any term(s) of this Agreement.
- Upon termination, you must cease all use of the App and destroy all copies, full or partial, of the App.
8. Warranty Disclaimer
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. RESPITA EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of Liability
IN NO EVENT SHALL RESPITA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; (iii) ANY CONTENT OBTAINED FROM THE APP; AND (iv) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
11. Changes to This Agreement
Respira reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
